1. Scope of application
(1) These General Terms and Conditions (GTC) apply to all contracts concluded between
outdoor-growset.com
(hereinafter referred to as the “Provider”)
and consumers or business customers (hereinafter referred to as the “Customer”)
via the Provider’s online shop.
(2) Any deviating, conflicting or supplementary terms and conditions of the Customer shall not become part of the contract unless the Provider has expressly agreed to their validity in writing.
(3) Individual agreements shall take precedence over these GTC.
2. Subject matter of the contract
(1) The Provider sells physical products in the field of gardening and outdoor growing via its online shop.
(2) The specific scope of services results from the respective product description in the online shop.
(3) The Provider does not owe any specific success, in particular no specific yield or specific usage outcome.
3. Conclusion of contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
(2) By submitting an order, the Customer makes a binding offer to conclude a purchase contract.
(3) The contract is concluded as soon as the Provider accepts the order by sending an order confirmation by email or by dispatching the goods.
4. Prices and payment conditions
(1) All prices stated in the online shop are final prices including statutory value-added tax, unless stated otherwise.
(2) Shipping costs are shown separately to the Customer during the ordering process.
(3) Payment is made using the payment methods offered in the online shop.
(4) The purchase price is due upon conclusion of the contract.
5. Delivery and shipping
(1) Delivery is made to the delivery address specified by the Customer.
(2) Delivery times stated in the online shop are non-binding unless expressly agreed as binding.
(3) Partial deliveries are permitted insofar as they are reasonable for the Customer.
(4) If a product is temporarily unavailable, the Customer will be informed without undue delay.
6. Retention of title
The delivered goods remain the property of the Provider until full payment of the purchase price has been made.
7. Right of withdrawal
(1) Consumers are entitled to a statutory right of withdrawal.
(2) Details of the right of withdrawal can be found in the separate withdrawal policy in the online shop.
8. Warranty
(1) The statutory warranty rights apply.
(2) The Provider does not assume any warranty for a specific suitability of the products for a particular purpose unless this has been expressly agreed.
9. Usage notes and responsibility of the Customer
(1) The products contain exclusively neutral gardening and growing materials.
(2) The Customer is solely responsible for using the products exclusively in compliance with the applicable legal provisions of the respective country.
(3) The Provider assumes no liability for improper or unlawful use of the products by the Customer.
10. Liability
(1) The Provider shall be liable for damages – irrespective of the legal grounds – only in cases of intent and gross negligence.
(2) In cases of simple negligence, the Provider shall only be liable for breaches of essential contractual obligations (cardinal obligations) and limited to the foreseeable damage typical for the contract.
(3) Liability for loss of profit, indirect damages or consequential damages is excluded.
(4) The limitations of liability shall not apply in cases of injury to life, body or health.
11. Data protection
The Provider processes personal data exclusively in accordance with applicable data protection laws.

12. Final provisions
(1) Amendments or supplements to these GTC must be made in writing.
(2) Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
(3) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(4) The place of jurisdiction shall be the Provider’s place of business, insofar as legally permissible.
